Welcome to Farmstander. We built this app because we believe in connecting people with local food and supporting the farmers and vendors who grow and produce it. These Terms of Service ("Terms") govern your use of the Farmstander app and related services ("Services"). By using our Services, you agree to these Terms. If you don't agree, please don't use the app.

1. Eligibility

You must be at least 13 years old to use Farmstander. By using the Services, you confirm that you meet this requirement. If you're between 13 and 18, please make sure a parent or guardian is aware of and approves your use of the app.

2. Accounts

You're responsible for keeping your account credentials secure and for everything that happens under your account. If you ever suspect unauthorized access to your account, please let us know right away at feedback@farmstander.com.

3. Acceptable Use

We want Farmstander to be a safe and trustworthy place for everyone. You agree not to: • Use the Services for unlawful purposes or to promote illegal activities. • Post or transmit harmful, infringing, or obscene content. • Attempt to gain unauthorized access to our systems or data. • Interfere with the normal operation or security of the Services.

4. Vendor Content

Vendors may post farmstand or farmers market information, photos, inventory, and other content. You keep ownership of the content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it as needed to provide the Services.

5. Intellectual Property

All intellectual property in the Services — excluding content submitted by users — is owned by us or our licensors and is protected by applicable laws in the United States, the European Union, the United Kingdom, and other jurisdictions.

6. Privacy

Your use of the Services is also governed by our Privacy Policy. We encourage you to read it — it's written in plain language and explains exactly what we collect, why we collect it, and how you can control it.

7. Respecting Other Users' Privacy

When you use Farmstander, you may receive contact information from another user — for example, a vendor receiving a customer's name and email address through an Order Request. This information is shared solely to facilitate communication related to that specific interaction. You agree that you will not use another user's contact information to send unsolicited messages, add them to mailing lists, contact them for purposes unrelated to the original interaction, or share their information with third parties without their consent. Misuse of contact information shared through the Services is a violation of these Terms and may result in account suspension or termination.

8. Order Requests and Off-Platform Transactions

Farmstander provides an Order Request feature that allows customers to communicate purchase interest to vendors. The following terms apply to all such interactions: • Farmstander is a communication platform only. We are not a party to any transaction between a customer and a vendor. We do not process, hold, facilitate, guarantee, or take any responsibility for any payment, exchange, or transfer of goods between users. • All payments and exchanges occur entirely off-platform, directly between the customer and the vendor at the time of pickup or as otherwise agreed. Farmstander has no involvement in and no liability for these transactions. • An Order Request is not a contract, a reservation, or a guarantee of availability. Submitting a request does not obligate a vendor to fulfill it, and does not guarantee that any item will be available, reserved, or held on your behalf. • Farmstander makes no representation or warranty that a vendor will respond to, accept, fulfill, or honor any Order Request. Vendors operate independently and at their own discretion. • Farmstander is not responsible for disputes between customers and vendors, including non-fulfillment, cancellations, product quality or condition, pricing disagreements, no-shows, or payment conflicts. • By using the Order Request feature, you acknowledge that you assume all risk associated with any transaction or exchange you enter into based on connections made through the Services. Farmstander expressly disclaims all liability in connection with such transactions.

9. Food Safety Disclaimer

Farmstander does not inspect, certify, license, regulate, or warrant the safety, quality, fitness for consumption, or compliance with applicable food safety laws of any products listed, offered, or sold by vendors through or in connection with the Services. Vendors are solely responsible for ensuring that any food products they offer comply with all applicable local, state, federal, and international food safety regulations, labeling requirements, and handling standards. Customers assume all risk associated with the purchase and consumption of food products obtained through connections made via the Services. Farmstander expressly disclaims all liability for any illness, injury, allergic reaction, or harm of any kind arising from the consumption or use of products obtained from vendors through or in connection with the Services.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Farmstander and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Without limiting the foregoing, Farmstander expressly excludes all liability arising from or related to: • Any transaction, payment, or exchange occurring off-platform between customers and vendors. • The fulfillment, non-fulfillment, or partial fulfillment of any Order Request. • The quality, safety, fitness for consumption, or legality of any food or other product offered or exchanged by vendors. • Any illness, allergic reaction, injury, or harm resulting from products obtained through connections made via the Services. • Any dispute between a customer and a vendor arising from or related to an Order Request or off-platform transaction. In all cases, our total aggregate liability to you for any claims arising under or related to these Terms or the Services shall not exceed the greater of (a) the amount you paid us, if any, in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Farmstander and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the Services, including any transaction or dispute arising from your use of the Order Request feature or any off-platform exchange with another user.

13. Termination

We may suspend or terminate your account and access to the Services if you violate these Terms or if required by law. Upon termination, your right to use the Services will cease immediately. We'll always try to communicate with you before taking action where it's appropriate to do so.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States (for U.S. residents), the laws of the European Union and its Member States (for EU residents), and the laws of the United Kingdom (for UK residents), without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts in your country of residence, unless applicable law provides otherwise.

15. Changes to the Terms

We may update these Terms from time to time. When we do, we'll post the changes in the app and update the "Last Updated" date. If the changes are material, we'll let you know as required by applicable law.
